By creating an account, accessing, or using HeyRik(the “Service”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms, and “you” refers to that organization.

You may use the Service only in compliance with these terms and all applicable laws and regulations. You agree not to misuse the Service, including by attempting to disrupt, probe, reverse engineer, or gain unauthorized access to any part of the platform, or by using it in a way that harms other users or third parties.

You are responsible for all activity that occurs under your account and for keeping your login credentials secure. Notify us immediately of any suspected unauthorized use of your account.

The Service may only be used for lawful, legitimate business communication with people you have the right to contact. When using HeyRik to place or receive calls — including campaigns — you must comply with all applicable telemarketing, robocall, automated-calling, do-not-call, caller-identification, call-recording, consumer-protection, and data-protection laws and regulations in every jurisdiction where you and the people you call are located (including, where applicable, TRAI regulations on commercial communications in India, the TCPA in the United States, and equivalent rules elsewhere).

In particular, you must: (a) obtain and maintain records of any consent required before contacting a person; (b) honor do-not-call registries and opt-out requests promptly; (c) not misrepresent your identity or the purpose of a call; and (d) disclose the use of an AI or automated agent where required by law. You may not use the Service for fraud, harassment, spam, threats, or any deceptive or unlawful purpose. We may monitor for abuse and may suspend or terminate accounts engaged in unlawful calling.

The voice features of HeyRikcreate a synthetic voice from audio you provide. You may only clone a voice that is your own or one for which you hold clear, documented consent from the voice owner. You may not use voice clones to impersonate any person, create deceptive or misleading “deepfake” content, or engage in fraud, and you remain fully responsible for how generated audio is used. We may remove voice clones or content that violate this section or the rights of others, and we cooperate with lawful requests from affected individuals and authorities.

You retain full ownership of the content, contact data, recordings, and transcripts processed through your account. We process that data only to provide the Service to you, as described in our Privacy Policy. We do not sell your data, we do not use it for advertising, and we do not use it to train shared or third-party AI models. You can export or delete your data at any time.

The Service can connect to third-party accounts you authorize — including Google Calendar and Google Sheets — so that your agents can check availability, book appointments, and record outcomes on your behalf. These integrations are optional. By connecting an account, you confirm that you are authorized to grant that access and that you hold any consent required from the people whose information is read from or written to it.

You remain responsible for what the agents you configure do within a connected account, including the events they create or change and the data they write. We act only on the instructions you and your agents give. Information received from Google APIs is handled in accordance with our Privacy Policy and the Google API Services User Data Policy, including its Limited Use requirements — we do not sell it, use it for advertising, or use Google Workspace APIs data to develop, improve, or train generalized AI or machine learning models.

Third-party services are governed by their own terms and privacy policies, and we do not control their availability, pricing, or behavior; they may change or withdraw access at any time. You may disconnect an integration whenever you wish, which revokes our access and will stop any workflow that depends on it. To the maximum extent permitted by law, we are not liable for loss arising from a third-party service’s unavailability or changes.

To access certain features you must register for an account and provide accurate, current, and complete information, and keep it up to date. You must be at least 18 years old and legally capable of entering a binding contract to use the Service. We reserve the right to suspend or terminate accounts that provide false information or violate these terms.

The Service is offered on paid plans and usage-based credits, billed at the prices clearly shown at checkout — there are no hidden charges. Calls and other usage draw down credits; when your balance is exhausted, paid features pause until you top up. Except where required by law or expressly stated otherwise, fees are non-refundable once the corresponding service has been delivered. We will give you reasonable prior notice of any pricing changes, which apply only to future purchases.

Your billing month runs from the date you subscribe to the same date of the following month — for example, a plan started on the 12th renews on the 12th. Where a month has no matching date, the period ends on that month's last day.

Credits do not carry forward.The credits included with your plan are valid only for the billing month in which they are granted. Any unused balance expires at the end of that month and is forfeited. Credits for the following month are issued only when that month is paid for — an unpaid or cancelled account's balance stays at zero until payment is made. If you change plan part-way through a month, the balance you are holding at that moment is carried onto the new plan and added to its allowance. Credits hold no cash value and are not exchangeable or refundable.

Any complimentary credits offered when you create an account apply to your first month only and are not reissued.

Calls are metered by the second and charged against your credit balance. A call placed over a phone number supplied through the Service also carries the telecom operator's own charge for that call, which is passed through to your balance at cost. A minimum balance may be required to start a call, since a call is only priced once it ends.

The Service, including its software, branding, and content, is owned by HeyRik and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms. You retain ownership of the content and data you submit, and grant us a limited license to process it solely to provide the Service to you — for no other purpose.

We work to keep the Service available and reliable, and we perform maintenance in a way that minimizes disruption. However, the Service depends in part on third-party networks and carriers, and we do not guarantee uninterrupted or error-free operation. We will communicate planned maintenance and material incidents through the Service where practicable.

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. AI-generated output may contain errors; you are responsible for reviewing it before relying on it for any consequential decision.

To the maximum extent permitted by law, HeyRik shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, and our aggregate liability shall not exceed the amounts you paid to us in the twelve months preceding the claim. Nothing in these terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold HeyRik harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these terms or applicable law — including calling-compliance and consent obligations — or from content and campaigns you run through the Service.

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these terms, use the Service unlawfully, or create risk or legal exposure for us, other users, or third parties — and where practicable we will notify you and give you an opportunity to remedy the issue first. Upon termination, your right to use the Service ceases, and you may export your data as described in our Privacy Policy before it is deleted.

These terms are governed by the laws of India, without regard to conflict-of-law principles, and the courts at the location of our registered office shall have exclusive jurisdiction — except where the law of your place of residence grants you non-waivable rights or venue. We encourage you to contact us first; most concerns can be resolved quickly and informally.

We may update these terms from time to time. Material changes will be communicated through the Service or by email with reasonable advance notice before they take effect. Continued use after changes take effect constitutes acceptance of the revised terms; if you do not agree, you may close your account before the changes apply.
